Refund & Cancellation Policy

Please Note: All financial transactions are handled by Paddle.com which is our Merchant of Record.  You will see their name listed on the transaction.

By creating an account with us, you explicitly agree to an ongoing subscription (until cancelled) and agree to the following policy and terms.  If you do not agree, do not continue.  For those that do, we look forward to growing with you.

Your card will only be charged at the end of the trial and at renewal unless you cancel from within your account in advance as mentioned in section 2. Refunds are provided as outlined in section 4. You will receive a copy of the email cancellation. If you do not have one, the account has not been cancelled.

Contractor Foreman is a family-owned business and we look forward to the opportunity to serve you.  It’s unlikely that there will be any complications, but due to some bad actors, we were asked to create a written policy that everyone must agree to prior to creating a subscription.  In the event of a dispute, your bank will refer to this policy to verify that payments and refunds were processed as outlined below. We look forward to serving you.

 

1.0 – Reminder Notifications

Upon creating an account, we will send you an Account Info email that contains your credentials, Trial Start, Trial End, Selected Plan Name, Amount, and Cancellation Instructions.  If the email address or the selected plan needs to be changed, reply to the email and let us know immediately.  On day 22 of the trial, we will send a reminder that includes the plan details and the amount your card will be charged at the end of the trial and and cancelation instructions.  It is our recommendation that you create a calendar event to remind yourself in advance of the trial ending.  You can see your renewal date, plan details, request a card update link, and submit a cancellation by going to Settings > Subscription.

 

2.0 – Cancellation Policy

Our cancellation policy is super simple.  Cancellations must be made exclusively through Settings > Subscription > Cancel by the primary administrator (the person who created the account). Once you fill out the form, a copy will be sent to you for your records.  The submission date is used to determine the refund amount (see Section 4.0 – Refund Policy).  If you do not have a copy of the cancelation form, then your account has not been canceled and you should not assume that it has been cancelled.  If this happens, contact support immediately.  Please remember that cancellation requests made any other way will not result in a cancellation.  Your sales rep, the chat team, not anyone else can cancel your account – only you can by doing so within Settings > Subscription > Cancel.  You can also go here using this link to access the cancellation form (available to admins only).

 

3.0 – Automatic Renewal

When you start a subscription with Contractor Foreman, you do so with the understanding that we will provide you with a 30-day free trial in which there will not be any charges made during the trial.  Day 1 of the trial will begin the moment your account is created and it will conclude after the 30th 24-hour period has ended.  If the account is cancelled (as required in the Cancellation Policy Section 4.0) prior to the trial ending, your account will be cancelled and there will not be any charges made to your account.  If your account is not cancelled (per the Section 4.0 Cancelation Policy) before the trial ends or before your automatic subscription renewal, your card will be automatically charged.  You must cancel as instructed in the Cancelation Policy to prevent the charge.  Although a trial ending and renewal reminder is designed to be sent prior to the charge, it is our recommendation that you create a calendar event to remind yourself in advance of the charge. The email going into junk or not being received does not justify a refund.

 

4.0 – Refund Policy

You are giving Contractor Foreman explicit permission to charge your card automatically at the end of the trial and with each subscription renewal. Your account is eligible for a refund based on the date in which you submit the cancellation request from your account (Settings > Subscription > Cancel).

Refunds are not calculated based on days used or remaining within a billing period but follow the schedule outlined below.

1-5 days of being charged = 75% refund + 25% credit on file for future use
6-30 days of being charged = 50% refund + 50% credit on file for future use
31-60 days of being charged = 25% refund
60-90 days of being charged = 15% refund
91+ days of being charged = 0% refund

 

5.0 – 100 Day Money-Back Guarantee

Some companies have a refund policy for 7 days… maybe 30 days.  We are so confident in Contractor Foreman that we give you up to 100-days to request a refund if you are not satisfied and no longer wish to use it. This guarantee is only available for annual plans and it does require that a few conditions be met prior to you requesting to cancel.  Why do we have these requirements in place? Our goal is to see you succeed and we want you to make a decision about Contractor Foreman based on you using it.  If you have given it a shot and it’s not for you, we understand.

Prior to requesting a refund, you must have…

  • Participate in a free one-on-one Demo/Orientation prior to signup or within 7 days of starting a trial. [Book it Here]
  • Participate in a free one-on-one Training session within the last 30 days of when you are requesting a refund. Menu > Training. (Group trainings (with other customers) do not count towards this requirement.) This allows us to show you the features you may not be aware of and answer any questions you may have.
  • Created (1) Estimate
  • Created (1) Project
  • Created (1) Time Card
  • Created (1) Daily Log

It’s as simple as that. Once you have completed these steps, you may reach out to support to confirm your eligibility for a refund.

Failure to meet the conditions will result in ineligibility for the money-back guarantee refund.

6.0 – Payment Disputes

In the event of a payment dispute, the customer forfeits the right to a refund and/or future credit, and any legal or dispute-related fees will be the customer’s responsibility.  When a dispute takes place, a copy of the terms that you have agreed to as well as email notifications, access logs, conversations, and all other evidence will be submitted to your bank to verify that the transaction was justified in accordance to the terms you agreed to.  Because disputes cost time and money, the customer hereby agrees to be responsible for any legal or dispute fees associated with this process as it pertains to the legal district of Rutherford County, North Carolina.

 

7.0 – Account Downgrade

In the event that an account needs to be downgraded within the first 30-days after signing up (or renewal), the downgrade will take place and a partial refund will be issued for a maximum of 50% of the original amount paid.  Example: For example, if you upgrade to a $1000 plan and downgrade to a $200 plan, $200 will be applied toward your new plan. A maximum refund of 50% of the original payment, in this case $500, will be issued.

 

8.0 – Account Deactivation

In the event that Contractor Foreman recommends deactivating your paid account, a refund will be issued based on the time remaining on the account.   If your subscription received any free time (free month for taking a training, free year (with Buy 2, Get 1 Free plan)), that will not be factored into the refund amount.  We will make all efforts to work together but we acknowledge that there are some relationships where continuing is not in the best interest of the customer and Contractor Foreman.  We will provide a minimum of 14 days to allow the customer to retrieve any records that need to be copied from the system.

 

 

9.0 – Free Month Promotions

Each customer may only receive one free month per promotion type in a rolling 12-month period.  Type Examples: Training, Service Issue, Extension, Billing Update.

 

10.0 – Paddle.com (Merchant of Record)

11.0 – Implementation Program

Our team will provide implementation assistance for a nominal fee as outlined on the Implementation webpage and within the signed agreement.  This fee is non-refundable even if the Trial or Account is cancelled. https://contractorforeman.com/implementation/

Billing Policy

When you signup for Contractor Foreman, you do so with the understanding that we will provide you with a 30-day free trial period in which there will not be any charges made during that time period.  Day 1 of the trial will begin the moment your account is created and it will conclude after the 30th 24-hour period has ended.  If the account is cancelled (see Cancellation Policy below) prior to the trial ending, your account will be cancelled and there will not be any charges made to your account.  If you desire to continue the service and/or do not contact us prior to the trial day date, your card will be automatically charged without any additional written notice other than what is stated here.  Once a card has been charged following the trial period, a refund will not be provided if requested.  If the plan is eligible for the 100 Day Guarantee (see 100 Day Guarantee policy below) and the customer has met the requirements stated within the policy, a full refund will be provided.  If all requirements have not been met, a refund will not be provided.  You should not continue the signup process if you have any questions or if you do not agree to the terms.  You should not check the ‘agree checkbox on the signup form if you do not agree to these terms.  By continuing the signup process, you agree to terms set forth.

Cancellation Policy

Our cancellation policy is super simple.  If you need to cancel your account, your account administrator must do so from the website (not mobile device) by going to Menu > Settings > Subscription Information and submitting the cancellation form. Once you fill out the form, we will send you a confirmation so that you have it for your records. Cancellation requests made any other way are NOT valid.  Request taken over the phone, email or chat will not be processed as those individuals are unable to submit the cancellation form for you.  You must submit the Cancellation Form from your web panel account.  https://www.contractorforeman.net/cancellation_request.php

Refund Policy

All customers will receive a 30-day free trial period in which they can use the service provided without a charge.  After day 30, the credit card on file will be charged the agreed upon price based on the frequency chosen by the customer.  This may be monthly, annually, or every three-years.  If you decide that Contractor Foreman is not for you, let us know within 30 days of creating your account so that we can prevent the charge from taking place. Per the Billing Policy stated above, refunds are not given after the conclusion of a trial.  Annual and 3-year subscribers can take advantage of the 100-Day Money Back guarantee program that we provide.

Renewal Refund Policy

To better serve our customers, the following refund policy outlines the refund you are entitled to.  This applies to renewals only – not new subscriptions.  If a customer does not wish for their account to be renewed automatically at the end of the subscription period, they must cancel their subscription from within their account by doing so in the web panel > Menu > Settings > Subscription Info > Cancel. Cancellations cannot be submitted any other way; such as phone, email, chat, during a training, etc. When you submit a cancellation, you will receive a copy of the request for your records.
80% refund (if cancellation & refund are requested) within 5 days of being charged.
50% refund (if cancellation & refund are requested) within 6-15 days of being charged.
25% refund (if cancellation & refund are requested) within 16-30 days of being charged.
0% refund (if cancellation & refund are requested) after 30 days of being charged.

100 Day Money-Back Satisfaction Guarantee

Some companies have a refund policy for 7 days… maybe 30 days.  We are so confident in Contractor Foreman that we give you up to 100-days to request a refund if you are not satisfied and no longer wish to use it. Available for Annual and Three-Year plans.  No other company comes close to this level of confidence. That said, we do have a few conditions you must meet to be eligible for the refund. Our terms are not an obstacle but instead, they are in place to ensure that you adequately give Contractor Foreman a try before giving up on it. Our goal is to see you succeed. Prior to requesting a refund, you must have… participated in a free one-on-one training session within 30 days of signing up and within the last 30 days of when you are requesting a refund.  Group trainings (with other customers) do not count towards this requirement.  This allows us to show you the features you may not be aware of and highlight new features added prior to the refund being processed. Additionally, you must add (1) Project and during the course of the project, create 3 Daily logs on separate dates. It’s as simple as that.

Payment Disputes

In the event that a payment is disputed, a copy of all agreed upon terms will be provided to the customers bank as well as access logs and any communication – anything necessary to ensure that a falsely submitted dispute is resolved favorably.  Contractor Foreman has the right to collect payment for all previous partial refunds and dispute fees, legal fees (and any other mentioned fees). If there is a billing issue, let’s work together.  In the event that a dispute is submitted, the customer forfeits any existing credit or any potential refund request regardless of the outcome of the dispute.  In the event that a customer submits a dispute and later decides to create a new account or reactivate an old account, Contractor Foreman has the right to collect payment for all previous partial refunds and dispute fees, legal fees (and any other mentioned fees) prior to continued usage.

Account Deactivation

In the extremely rare event that your paid-in-full account is recommended for deactivation by Contractor Foreman, you will be refunded the balance of the account based on the time that remains.   If your subscription received any free time (free month for taking a training, free year (with Buy 2, Get 1 Free plan)), that will not be factored into the refund amount.  We will make all efforts to work together but we acknowledge that there are some relationships where continuing is not in the best interest of the customer and Contractor Foreman.  We will provide a minimum of 14 days to allow the customer to receive any records that need to be copied from the system.

Account Downgrade

In the event that an account needs to be downgraded within the first four months after signing up (or renewal), the downgrade will take place and a partial refund will be issued for a maximum of 50% of the original amount paid.  Example: If someone signs up for a 10 user plan for $1000 and downgrades to a $200 1 user plan, $200 of the $1000 will go towards the upgrade.  $300 will stay on file as a future credit.  $500 will be refunded back to the customer on the card used during the signup.

Free Month Promotions

If a free month of service is offered for any reason, the customer may only receive one free month per promotion type per calendar year.  Type Examples: Training, Service Issue, Extension, Billing Update.
